A Western Court That Embraces Sharia Is A Sharia Court: Sharia Subversion In The American Legal System

On 9 July 2012, the International Civil Liberties Alliance (ICLA) launched and initiative in the European Parliament called the Brussels Process. This was a response to the efforts of the Organisation of Islamic Cooperation to undermine basic freedoms and spread sharia compliance to the non-Islamic world.

An article by Eric Allen Bell has recently been published at FrontPage Magazine entitled ‘The Threat of Sharia and the Leadership of America’s Two Parties’. This article clearly illustrates how sharia principles are being taken into consideration by American courts and how this can create a situation where Muslim women are not provided with the same rights and protections as other Americans.

To incorporate a system that is incompatible with democracy into the American legal system is likely to subvert that system and the society in which it operates. Of course sharia promotes and institutionalises inequality and this is a violation of the principles of the American Constitution. A legal system that bows to sharia is a legal system that embraces it. A Western court that embraces sharia is effectively a sharia court in all but name. Sharia is not an enhancement to Western legal systems, it is an alternative. Those who are not opposing sharia in American legal institutions are, in effect, supporting institutionalised inequality and are undermining the rights of the individual. The FrontPage Article gets to the crux of the issue as follows:

“If we do not take a stand, and demand the policy of American laws for American courts, there will most certainly be more innocent women and children victimized by the brutal and misogynistic Sharia Legal system and denied their full civil rights in America.”

Since the Brussels Process does not require people to work with us we like to highlight situations when people are independently following the principles of the Brussels Process and thus contributing to the preservation of liberty that is its central objective. We would like therefore to commend the efforts of Mr Eric Allen Bell and those who are clearly participating in the Brussels Process by opposing sharia subversion in the American legal system.
